By accessing or using Cover Forge (the "Service"), operated by OPHARANA LLC, located at 99 Wall Street, Suite 1432, New York, NY 10005, United States, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Cover Forge is an AI-powered album cover generation platform. Users can generate digital artwork based on text prompts and optional reference images. The Service operates on a freemium credit-based model.

3. User Accounts

To access the generation features, you must create an account by providing a valid email address and password. You are solely responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old or the age of majority in your jurisdiction to use this Service.

4. Credits & Payments

New accounts receive a limited number of free credits. Additional credits can be purchased through our payment processor, Stripe. All purchases are final and non-refundable unless otherwise required by applicable law. Prices are displayed in the currency indicated at checkout and include any applicable taxes.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Generate content that infringes upon the intellectual property rights of any third party.
• Generate content depicting minors in inappropriate or exploitative contexts.
• Attempt to reverse-engineer, decompile, or otherwise exploit the underlying AI models.
• Use automated systems (bots, scrapers) to access the Service without prior written consent.
• Circumvent or manipulate the credit system or any security measures.

6. Intellectual Property

The generated images are provided "as-is." You are granted a non-exclusive, worldwide license to use, modify, and distribute the images you generate for personal and commercial purposes. OPHARANA LLC makes no representations or warranties regarding the uniqueness of generated images or their suitability for any particular purpose. You are solely responsible for ensuring your use of generated images does not infringe upon the rights of others.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPHARANA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, unused credits are forfeited and non-refundable.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
